BLOOM FRESH secures major victory in Peru table grape infringement case

PERU – After months of diligent investigations and legal proceedings, BLOOM FRESH, a leading global producer of table grapes, cherries, and raisins, has successfully concluded its largest infringement case to date in Peru.

The company has enforced the removal of 110 hectares of illegally planted varieties including Sweet Globe, Jack’s Salute, Sweet Celebration, and Allison.

This landmark action marks the biggest removal of illegal plantings in the history of table grape infringement cases in Peru. Alongside the destruction of the plants, the infringing grower faces a significant economic penalty.

BLOOM FRESH issued a strong warning to other growers contemplating similar actions. “We will continue to act with the strongest legal recourse against nurseries and growers who illegally use our varieties and trademarks,” a company representative stated.

The illegal plantings were discovered in southern Peru. The grower was forced to uproot and remove the 110 hectares at his own expense, a move that will severely impact his future earnings. Additionally, he must pay a hefty fine for his infringement.

BLOOM FRESH emphasized its ongoing efforts to monitor the market and ensure compliance with its patents. The company has local and international legal teams ready to respond to any detected infringement.

“Today we are sending a very clear message to the industry and growers who are thinking of planting BLOOM FRESH varieties illegally,” said Josep Estiarte, CEO of BLOOM FRESH.

“Infringement of our intellectual property will not be tolerated, and we will employ all our resources against anyone who thinks they can get away with it. This case demonstrates the significant financial consequences that infringing growers will face.”

Estiarte further explained the importance of this victory. “Legitimate producers around the world have placed their trust in us to help them build their businesses for the long term. We must protect their interests by ensuring that those who wish to plant our varieties illegally are held accountable,” he added.

BLOOM FRESH is also a founding member of The Global Breeders Alliance, which has a network of investigators globally to detect infringements.

The company routinely conducts DNA testing on suspected illegal fruit or plants and collaborates closely with major retailers and distributors worldwide.

This case underscores BLOOM FRESH’s commitment to safeguarding its intellectual property and supporting legitimate growers.

By taking decisive action against infringers, the company aims to maintain the integrity of its patented varieties and the trust of its partners.

Upcoming global grape convention

In a related development, Chile and Peru will join forces on August 8, 2024, at the first Global Grape Convention at the Casino Monticello Events Center.
